Welcome to Mozahik (the “App”). These Terms of Use (the “Terms”) are a legally binding agreement between you andTuan Dev Limited (“we,” “us,” or “our”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility (18+)

You must be at least 18 years old to use Mozahik. By using the App, you represent and warrant that you are 18+ and legally capable of entering into these Terms. We do not knowingly allow or collect data from anyone under 18. If you believe a user is under 18, please report it to contact@mozahik.com.

2. Account & Verification

• You must use accurate, current, and complete information.
• One account per person; you may not share or sell your account.
• We may offer or require identity or photo verification to enhance trust and safety. Verification helps reduce fake profiles but does not guarantee a user’s identity or intentions.
• We do not perform criminal background checks, and we do not vouch for any user.

3. Safety & Your Responsibilities

You are solely responsible for your interactions on and off the App, including in-person meetings. Exercise caution and common sense:

• Meet in public places; tell a friend where you’re going.
• Do not share sensitive information (financial data, home address, etc.).
• Block and report suspicious or abusive behavior.
• We are not responsible for the conduct of users on or off the App. In an emergency, contact local authorities.

4. Acceptable Use & Prohibited Content

You agree not to:

• Use the App if you are under 18.
• Post or share content that is illegal, hateful, harassing, threatening, defamatory, discriminatory, or invasive of privacy.
• Post sexually explicit content, sexual content involving minors, or content that sexualizes exploitation or non-consensual activity.
• Promote or solicit sex work, human trafficking, or exploitation.
• Impersonate others, misrepresent your identity, or use another person’s photos without permission.
• Upload viruses, malware, or engage in scraping, spamming, or automated data collection.
• Use the App for commercial advertising or fundraising without our prior written consent.

5. User Content & License

You retain ownership of content you submit (text, photos, videos, etc.) (“User Content”). You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt, publish, and distribute your User Content solely for operating, improving, promoting, and providing the App. You represent and warrant that you have all rights to your User Content and that it does not violate these Terms or any third-party rights. We may remove content at our discretion.

6. Subscriptions, Purchases & Renewals

• Some features may require in-app purchases or subscriptions (the “Paid Services”).
• If purchased via the Apple App Store or Google Play, billing, renewals, cancellations, and refunds are governed by their terms. Manage or cancel via your store settings at least 24 hours before renewal to avoid charges.
• Unless stated otherwise, subscriptions auto-renew until canceled.
• Fees are non-refundable except where required by law or platform policy.

7. Communications & Notifications

You consent to receive messages (e.g., OTP codes, security alerts, service updates) via the App, email, or SMS. You can opt out of non-essential marketing messages at any time, but you may still receive transactional or safety-related communications.

8. Location Features

Some features rely on approximate or precise location. By enabling location services, you consent to our processing of location data to provide those features (e.g., nearby matches). You can disable location in your device settings; certain features may not work without it. See our Privacy Policy for details.

9. Third-Party Services

The App may link to third-party sites or services. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

10. Intellectual Property

The App, including its design, trademarks, logos, and software, is owned or licensed by us and protected by law. Except for your limited right to use the App under these Terms, no rights are granted. You may not copy, modify, distribute, or create derivative works without our permission.

11. DMCA / IP Notices

If you believe content infringes your rights, email [Contact Email] with: (a) your contact info; (b) a description of the work infringed; (c) the infringing material’s URL or location; (d) a statement of good-faith belief; and (e) a statement under penalty of perjury that the notice is accurate and you are authorized to act, plus your signature. We may remove content and terminate repeat infringers’ accounts.

12. Termination

We may suspend or terminate your account at any time for any or no reason, including violations of these Terms or risk to other users. You may delete your account at any time in the App. Some provisions survive termination (e.g., IP, disclaimers, limitation of liability, indemnity).

13. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PARTICULAR OUTCOME, MATCH, OR COMPATIBILITY. YOUR USE IS AT YOUR SOLE RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP IN THE 12 MONTHS PRIOR TO THE CLAIM OR $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS; THESE MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the App, your User Content, or your breach of these Terms or applicable law.

16. App Store & Google Play Terms

• These Terms are between you and [Company Name], not Apple or Google. We, not Apple/Google, are responsible for the App and its content.
• Apple/Google have no obligation to provide maintenance or support.
• In case of any third-party claim that the App infringes IP rights, we (not Apple/Google) are responsible for investigation/defense.
• You must comply with applicable App Store or Google Play terms.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Governing Law & Jurisdiction], without regard to conflict of law principles.(Optional) Any dispute will be resolved by binding arbitration on an individual basis in [City, Country]. You waive any right to participate in class actions. If arbitration is not permitted in your jurisdiction, disputes shall be resolved in the courts of [Jurisdiction].
